From 1 July 2026, Victorian employees gained the right to request up to five days of paid mental health leave each year without needing a doctor's certificate for the first two days.

The change arrives as reports show rising stress levels among office workers in the CBD and inner suburbs. Many staff at firms along Collins Street and Flinders Lane report long hours that spill into evenings, leaving little recovery time before the next commute.

Pilates studios on Brunswick Street in Fitzroy offer early-morning classes priced at $28 a session, while similar venues in Collingwood provide after-work slots aimed at shift workers.

Rights under the new rules

Employers must respond to leave requests within seven days or face penalties through the Fair Work Ombudsman. The rule builds on existing flexible-work provisions that took effect in 2023. A 2025 survey by the Australian Bureau of Statistics found 34 percent of Victorian workers aged 25 to 44 had taken at least one mental health day in the previous 12 months.
